He doesn't think that they'll be able to tell her the truth for a little while, not until she trusts them more but it can't hurt to plant the seed.
It actually works in their favor that no one else is home right now. Gives them more time to make up a plausible story and when Emma looks up at him, he smiles back at her.]

Even if it might take time to get through the paperwork and formalities of going through the process of them adopting her or what not as necessary here.

As much as a six foot man made of muscle can really look soft but when she says that she hasn't any happiness left to steal, it makes him sad for her. It may look like pity but really he wants to help her regain her kingdom and bring something of a happy ending back for her.

[ she doesn't want him to pity her, that's not her intent in telling him what she's been through. it's more that she knows how Regina operates. she's seen time and time again that the woman likes to take whatever her enemy holds dear, and she did that when she took the lives of Emma's parents. she should be able to leverage their marriage as a threat to Regina's power, but he can handle himself better than any human man could.
besides, no matter what circumstances they've met under, he's still going to be her husband. she has her own magic to protect him with, and if she falls in trying to save the Enchanted Forest, he'll have claim to the throne once they're married. there's a rumor that he likes humans, she doubts he'd do wrong by them.]

( Ben has never been great with dates, they all tend to blur together because nothing ever happens in Storybrooke. he could lose years of his life, he thinks, and never even notice... and that's pretty sad, considering he's only 18. a year is a pretty large fraction to lose sight of, and yet his life had always been so unremarkable that it seemed utterly possible to wake up and realize he'd lost a year of it in banal normality.
that all changed with Lucy, though. he remembers very well the day they bickered over pizza. he remembers the thrill of convincing her to come over for a movie marathon instead of trying to bully him into his statistics homework — her terms had been he had to actually do it, possibly under the impression he wouldn't be able to. it was shocking how quickly he could get it done with a little motivation — he certainly remembers the night a few weeks ago when they kissed, when they...
it'd be pretty impossible for him to forget, frankly... though after it happened, he hadn't seen a lot of her, and he doesn't know what to do. because yeah, he gets she has a perfect life and he's messing it all up, but she's about the only good thing he has, and he gets how teenage angst that is, when they've known each other for a few months. it doesn't keep it from being true.
he drops his phone in the nervous scramble to grab it when she texts. he knows it's her, because nobody else would bother. it is... decidedly not what he wants to see, though, especially after so much strained silence. he would have liked to talk to her for weeks now, and suddenly that the moment is happening he finds he wishes it wasn't.
